Right of withdrawal

Introduction

Consumers have a right of withdrawal under the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither their trade nor their independent professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Berlin Tires Europa GmbH,

You may use the attached model withdrawal form, but it is not obligatory.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive the notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must return or hand over the goods without undue delay and in any event not later than fourteen days from the day on which you notify us of the withdrawal from this contract.

The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods. The direct costs of return for goods that, due to their nature, cannot normally be sent back by post (freight goods), are estimated at a maximum of about 14.50 EUR per package for each such item.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.

Linked/Financed Transactions

If you finance this contract through a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided both contracts form an economic unit. This is especially assumed if we are simultaneously your lender or if your lender uses our cooperation for the financing. If the loan has already been paid to us when the withdrawal becomes effective or when the goods are returned, your lender steps into our rights and duties from the financed contract in relation to you regarding the legal consequences of the withdrawal or return. The latter does not apply if this contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you want to avoid contractual binding as far as possible, make use of your right of withdrawal and also withdraw from the loan agreement if you have a right of withdrawal for it.
